1 Acceptance of Terms

By accessing or using the Toon It! application ("Service"), available at toonit.ai/, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you") and Toon It! ("we," "us," "our"). We reserve the right to update these Terms at any time, and continued use of the Service constitutes acceptance of any modifications.

2 Service Description

Toon It! is an AI-powered creative platform that transforms your photographs into enchanting storybook-style illustrations and short animated videos. The Service operates through the following pipeline:

1. Photo Upload — You capture or select a photograph.
2. Style Transformation — AI transforms your photo directly into your chosen artistic style using advanced image-to-image generation.
3. Style Transformation — AI image-generation models convert the photo into a Storybook / Fantasy art style.
4. Video Animation — The transformed image is animated into a short video (approximately 5–7 seconds) with subtle, whimsical motion.
5. Delivery & Storage — The finished video is delivered to you and stored in your account.

Results may vary depending on input quality, content, and the inherent nature of AI processing. We do not guarantee specific artistic outcomes.

3 User Accounts & Authentication

To use the Service you must create an account. Authentication is managed through Supabase, a third-party authentication provider.

• You must provide a valid email address and create a secure password.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• You may not create multiple accounts to circumvent restrictions or abuse the Service.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4 Credit System & Payments

Toon It! operates on a credit-based system. Each transformation (photo → storybook video) consumes 1 credit. Credits must be purchased before use and do not expire.

Payment Processing

All payments are securely processed through Stripe. We do not store your full credit card details on our servers. By making a purchase you agree to Stripe’s Terms of Service.

• Credits are added to your account immediately upon successful payment.
• All prices are listed in US Dollars (USD).
• Applicable taxes may be added at checkout depending on your jurisdiction.

5 Content & Usage

Your Content

You retain ownership of the photographs you upload and the AI-generated storybook images and videos produced by the Service ("Generated Content"). By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

• Process and transform your uploaded photos as necessary to deliver the Service.
• Display Generated Content for promotional, portfolio, or marketing purposes (e.g., showcasing transformations on our website or social media), unless you opt out by contacting us.
• Store your content on our infrastructure and third-party providers for delivery purposes.

Your Responsibilities

You represent and warrant that you have the right to upload any photograph you submit, and that your use of the Service does not infringe upon the rights of any third party.

6 Prohibited Uses

You agree not to use the Service for any of the following:

• NSFW Content — Uploading or generating sexually explicit, pornographic, or obscene material.
• Illegal Activity — Any use that violates applicable local, state, national, or international law.
• Harassment & Abuse — Creating content intended to harass, bully, threaten, or defame any individual or group.
• Copyright Violations — Uploading images you do not own or have rights to, or using the Service to infringe on intellectual property rights.
• Deception & Fraud — Creating misleading deepfakes or content designed to deceive others.
• System Abuse — Attempting to reverse-engineer, exploit, or overload the Service infrastructure.

Violation of these rules may result in immediate account termination without refund.

7 AI-Generated Content Disclaimer

Toon It! uses artificial intelligence models to transform your images into artistic styles. Please be aware that:

• AI-generated results are non-deterministic — the same input photo may produce slightly different outputs on different occasions.
• Generated content may occasionally contain unexpected artifacts, distortions, or interpretations.
• We do not guarantee that the output will meet any specific artistic, aesthetic, or accuracy standard.
• AI models are provided by third-party services and may change or improve over time, which can affect output quality or style.
• You are solely responsible for reviewing Generated Content before sharing or publishing it.

8 Refund Policy

Due to the digital nature of our product, all credit purchases are generally non-refundable. Credits are delivered instantly upon payment and represent access to a digital transformation service.

However, we review refund requests on a case-by-case basis. You may be eligible for a refund or credit if:

• A technical error on our end prevented your transformation from completing and credits were deducted.
• You were charged multiple times for the same purchase due to a payment processing error.
• The Service experienced significant downtime that prevented you from using purchased credits.

To request a refund, contact support@toonit.ai within 14 days of your purchase with your transaction details.

Video Retention Policy

Generated videos are stored on our platform subject to the following retention policy:

• Standard retention: All generated videos are stored for 90 days from the date of creation.
• Warning notifications: We will send email notifications at 60 days (30 days before expiry) and 85 days (5 days before expiry) to remind you to download your videos.
• Automatic deletion: After 90 days, videos are permanently deleted from our servers and cannot be recovered.
• Download responsibility: You are responsible for downloading and saving any videos you wish to keep before the retention period expires.
• Premium retention: Premium subscription members may receive extended or unlimited video retention as part of their subscription benefits, as described in the applicable plan details.
• Immediate deletion: You may request immediate deletion of your videos at any time through your dashboard or by contacting support@toonit.ai.

We reserve the right to modify the retention period with 30 days' notice to affected users.

9 Intellectual Property

The Toon It! name, logo, branding, website design, underlying code, AI pipeline, and all associated intellectual property are owned by Toon It! and protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any part of the Service (excluding your own Generated Content) without our prior written consent.

10 Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not warrant that the Service will be uninterrupted, secure, or error-free.
• In no event shall Toon It!, its operators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
• Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11 Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:

• Violation of these Terms of Service.
• Engaging in prohibited uses as outlined in Section 6.
• Fraudulent or suspicious payment activity.
• Extended inactivity (accounts unused for more than 24 months).

You may delete your account at any time through your account settings. Upon termination, unused credits are forfeited unless a refund is approved under our Refund Policy.

12 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Effective Date" at the top of this page.
• Notify registered users via email for material changes.
• Post a prominent notice on the Service for at least 30 days.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
